AFFORDABLE CONNECTIVITY PROGRAM (ACP) TERMS AND CONDITIONS

Please carefully read the Terms and Conditions for the Affordable Connectivity Program. The Affordable Connectivity Program is a federal program that provides subsidized internet service for eligible customers.

  • Up to one $30 per month subsidy for each eligible household
  • Up to one $75 per month subsidy for each eligible household on Tribal lands

Figgers Communications is approved by the federal government to participate in the Affordable Connectivity Program. Figgers Communications offers a discount to provide internet access to our customers who are enrolled in the Affordable Connectivity Program. With Affordable Connectivity Program, Figgers Communications customers can get free internet service.

Households may be eligible for the Affordable Connectivity Program if they are qualified for Lifeline, free or reduced-price school lunch, Pell Grant, or the Special Supplemental Nutrition Program for Women, Infants and Children (WIC). The broadband, internet and wireless services are provided by Figgers Communications. By enrolling in the Affordable Connectivity Program, you agree to these terms and conditions. If these Terms and Conditions are not acceptable to you, please notify Figgers Communications immediately at Customer.Service@figgers.com.   

Consent to Use Electronic Records and Signatures. 

You agree to accept all communications electronically and use electronic signatures (“Consent”) with Figgers Communications and our controlled subsidiaries, assignees, agents and participating financial institutions and any entity assigning an Equipment Installment contract to us. Unless you agree, we are required to provide some Communications to you in writing.

What Types of Communications Will I Receive Electronically? 

Your Consent applies to your entire relationship with us, including this transaction. Unless you withdraw your consent, your agreements with us, equipment installment plan contracts, lease agreements, monthly statements and any disclosures, notices or other information about your relationship with us (“Communications”) will be delivered electronically. We may, if we choose, require Communications to be in writing.

  1. How Do I Withdraw Consent? You may withdraw your Consent:
    1. before you submit the online application. You have the right to withdraw your consent to receive Electronic Records at no cost to you. If you wish to withdraw your consent, you can exit out of this application system at any time prior to finalization of the contract. If you do not consent to receive Electronic Records, you will be unable to contract with Assurance Wireless through the website.
    1. after you have completed an online application, whenever you want without charge, you can change your email and contact preferences by visiting your account at https://www.figgers.com/myacp or calling us at 1–800–223–5435. All Communications provided prior to your withdrawal of Consent are still valid. After you withdraw Consent, your future Communications with us will be in writing whenever required by law.
  2. Are there any Computer Hardware, Software and Other Requirements? You must have the following items and features in order to receive the Communications electronically:
    1. A computer with an Internet connection.
  3. A current Web browser that supports TLS 1.2 encryption. Minimum recommended browser standards with default settings are Google Chrome version 38.0 and above, Mozilla Firefox version 27.0 and above, Microsoft Internet Explorer version 11.0, Microsoft Edge and Apple Safari version 7.0 and above. The browser must have JavaScript and cookies enabled.
    1. A valid email address.
  4. Sufficient storage space to save past Disclosures and/or an installed printer to print them.

You acknowledge that Figgers Communications has clearly disclosed to you that:

  • The Affordable Connectivity Program is a government program that reduces your broadband Internet access service bill;
  • If the Affordable Connectivity Program ends, or upon disenrollment from the Affordable Connectivity Program, or if you transfer your benefit to another provider but continue to receive service from Figgers Communications, you will be subject to Figgers Communications’ undiscounted rate and general terms and conditions;
  • We have the right to disconnect your Affordable Connectivity Program-supported service after 90 consecutive days of non-payment.
  • As an Affordable Connectivity Program customer you have the right to file a complaint at ACP Center by calling 888-225-5322.

You authorize Figgers Communications to communicate any information provided (including full name; full residential address; date of birth; the telephone number associated with the Affordable Connectivity Program service; the date on which the Affordable Connectivity Program discount initiated; the date on which the Affordable Connectivity Program discount terminated if it has terminated; the amount of support sought for that service; and the means through which you qualified for the Affordable Connectivity Program) to the Universal Service Administrative Company (USAC) to ensure proper administration of the Affordable Connectivity Program and/or connected device benefit. Failure to provide consent will result in being denied the Affordable Connectivity Program service and/or the connected device benefit.

You authorize Figgers Communications to query the National Lifeline Accountability Database to determine whether you have previously received a connected device benefit.

If you already receive Affordable Connectivity Program supported service with another provider, then you understand the following:

  • That you will be transferring its affordable connectivity program benefit to Figger Communications;
  • That the effect of the transfer is that your Affordable Connectivity Program benefit will be applied to Figgers Communications service and will no longer be applied to service retained from your previous provider;
  • That you may be subject to my previous provider’s undiscounted rates as a result of the transfer if you elect to maintain service from that provider; and
  • That you are limited to one affordable connectivity program benefit transfer transaction per service month, except to reverse an unwanted transfer or if you are unable to receive service from a specific provider.

All the answers and agreements that you provided on this form are true and correct to the best of my knowledge.  You accept Figgers Communications Terms and Conditions of Service and Agreement to Arbitrate Disputes https://www.figgers.com/terms-and-conditions/#disputeresolution.

Confirmation of Your Consent.
By providing your Consent, you confirm you have reviewed the above and agree (1) to electronically receive all Communications; (2) to use electronic signatures; and (3) that you have hardware, software (including PDF reader), email and SMS access to receive Communications electronically. You understand this is a digital signature and is the same as if you sign your name with a pen.

You represent that you are authorized and are providing this Consent on behalf of yourself.
